This work is the result of an investigation into the broadly political attitudes of the Appellate Division in its first forty years. The characters and utterances of the judges of appeal are examined in detail, as they appear in cases involving civil liberties, rebellion, industrial relations and questions of race. Trends and peculiarities are isolated, and the role of the judiciary in the interpretation of government policy is assessed. The author concludes that the reputation of the A.D. for bold liberalism in that period rests on shaky foundations, and calls for wide-ranging and public debate on the part played by the judiciary in South Africa.

This book promises to be of great importance and interest to all those interested in the courts, government and history of South Africa.
