AntiquarianAuctions.com - Terms of Service
These terms are the general terms of the relationship between us and you. The terms cover any transactions where we provide online book brokering in the form on an online auction and related services to you. The commercial terms of any transaction will be contained in a service request that will incorporate these terms. The service request will prevail if there is a conflict of meaning. Nothing in the terms obligates any party to enter into any orders.

- Definitions in the service request. Words defined (or assigned a meaning) in a service request will have that meaning in the terms, unless the context clearly indicates otherwise.
- Interpretation. All headings are inserted for reference purposes only and must not affect the interpretation of the agreement. Whenever "including" or "include", or "excluding" or "exclude", together with specific examples or items follow a term, they will not limit its ambit. Terms other than those defined within the agreement will be given their plain English meaning. References to any enactment will be deemed to include references to the enactment as re-enacted, amended, or extended. A reference to a person includes a natural and juristic person and a reference to a party includes the party’s successors or permitted assigns. Unless otherwise stated in the agreement, when any number of days is prescribed in the agreement the first day will be excluded and the last day included. The rule of construction that an agreement must be interpreted against the party responsible for its drafting or preparation does not apply. GMT +2 will be used to calculate any times.
The terms commence on acceptance and continue until terminated. Where the duration of this agreement is specified in a service request, if you are a “consumer” for purposes of the Consumer Protection Act, you may terminate the relevant service prior to the expiry of the term on 20 business day’s written notice to us. However, we may charge you an early termination fee.

- Invitation to do business. The marketing of the services by us is merely an invitation to do business or for you to make an offer to procure services. The parties only conclude a valid and binding service request when we accept the offer made by you. Unless proven to the contrary, we only accept an offer relating to services, when we begin providing the services. We may accept or reject any offer. If we do not accept any offer, then we will refund any monies already paid by you.
- Deemed service request. You will be deemed to have placed a service request in regard to services when you start consuming any services you have requisitioned automatically from the dashboard, it being agreed that each click of a button to requisition a service constitutes a billable event.

- Orders. The terms in effect at the time you make an offer will govern the service request. Each service request will create a separate agreement. Despite that, we may consider the breach of any one service request to constitute a breach of any or all orders.

- Right to cancel. We may cancel a sale at any time for any reason.

- Fee changes. We may change our transaction fee or our fee policies from time to time at our discretion.
- Venue and platform. The website is a venue for the purposes of the auction. We merely provide a platform for the transaction and are not involved in the actual sale between the buyer and the seller.
Not an auctioneer. We are not a traditional 'auctioneer', despite the fact that we refer to ourselves as an online auction website. The website is a marketplace that allows sellers to offer goods in the form of books to buyers using our auction-style format that we refer to as an online auction. We have no control over:
• the quality of the goods any buyers sell;
• the legality of any of the goods they advertise;
• the truth or accuracy of any of their listings;
• the seller's capacity to sell the goods;
• the buyer's ability to pay for the goods; or
• whether the buyer or seller will actually complete the transaction.
- Mere intermediary. We are a mere intermediary which means that we do not transfer ownership of the goods from the seller to the buyer. The parties do this between themselves.
- Identity authentication. We use many techniques to check the accuracy of the information our users provide us when they register on the website. This process is called authentication. But, we cannot verify each user's identity with absolute certainty because we can never be certain that someone is exactly who they purport to be.
- Not liable. We are not liable for any damages arising out of any disputes between you or any other users related to a transaction because we are merely a marketplace and in no way involved in the actual transaction.
- Free services. We do not charge you fees to:
- No control. We do not control any information that users provide to each other through our system.
- Not responsible. You may find other user's information offensive, harmful, inaccurate, or deceptive – but, unfortunately we are not responsible for it.

• dealing with people younger than 18;
• dealing with people under false pretences; and
• trading internationally with foreign nationals.

• the buyer fails to meet the terms of your listing (such as payment method), or
• you cannot authenticate the buyer's identity (in which case you should notify us).
- Fraud. We may suspend or terminate your account if we suspect that you have engaged in fraudulent activity in connection with the website.

If permissible under applicable law, legal costs will be on an attorney and own client basis.
- Access. On a party’s reasonable written request, the other party will provide the requesting party with the information that it has regarding your data and its processing that is necessary to enable the requesting party to comply with its obligations under this clause and the applicable laws. The requesting party will reimburse the other party for its reasonable charges for its assistance.

- Trade marks. Our logo and sub-logos, marks, and trade names are our trade marks and no person may use them without permission. Any other trademark or trade name that may appear on our marketing material is the property of its respective owner.

- Prosecution. All violations of proprietary rights or the agreement will be prosecuted to the fullest extent permissible under applicable law.
- Responsibility to keep information confidential. Each party must keep confidential any information it receives from the other party or under this agreement.
